1. Acceptance of Franchise Terms
By applying for, registering for, purchasing, operating or continuing a GCC Education Academy franchise, the franchise applicant or franchisee confirms that they have read, understood and agreed to these Franchise Terms & Conditions.
These terms should be read together with any franchise application, approval letter, fee structure, operational guidelines, written instructions and other applicable policies issued by GCC Education Academy.
Franchise approval is subject to the verification and approval of GCC Education Academy. Submission of an application does not automatically guarantee franchise approval.
2. Franchise Eligibility
A person, institution, organization or business entity wishing to operate a GCC Education Academy franchise must satisfy the eligibility requirements determined by the Academy.
Eligibility may include:
- Being legally capable of entering into an agreement.
- Providing valid identity and contact information.
- Providing required address and business information.
- Having suitable premises where required.
- Having adequate infrastructure for proposed activities.
- Maintaining professional and ethical conduct.
- Complying with applicable laws and regulations.
GCC Education Academy reserves the right to accept, reject or place conditions on any franchise application at its discretion, subject to applicable law.
3. Franchise Application & Approval
The applicant must provide complete, accurate and authentic information during the franchise application process.
GCC Education Academy may verify documents, communication details, business information, premises and other information before granting approval.
- False information may result in rejection.
- Incomplete applications may not be processed.
- Approval may be subject to additional documentation.
- Approval may be withdrawn where material information is found to be false or misleading.
4. Franchise Fees & Payments
The franchisee shall pay the applicable franchise registration fee, franchise fee, renewal fee, service fee, training fee or any other applicable amount communicated by GCC Education Academy.
Payment must be made through the officially approved payment methods of the Academy.
Once a franchise payment has been successfully received, the amount shall be treated as non-refundable and shall not ordinarily be returned, including where the franchisee later changes their mind, does not continue operations, becomes inactive or decides not to use the franchise services.
Nothing in these terms is intended to exclude or restrict any right or remedy that cannot legally be excluded under applicable law.
5. Franchise Territory
Where a specific territory, city, district or area has been allocated to a franchisee, such allocation shall be governed by the written approval or franchise documentation issued by GCC Education Academy.
Territory allocation does not automatically create ownership of the geographical area.
GCC Education Academy may determine the operational territory, service area and conditions applicable to a franchise location.
6. Brand Name, Logo & Intellectual Property
The GCC Education Academy name, logo, website content, designs, course materials, documents, graphics, trademarks, branding elements and other intellectual property remain the property of their respective owners.
A franchisee receives only the limited permission necessary to operate the approved franchise according to the instructions of the Academy.
The franchisee must not:
- Modify the official logo without permission.
- Register confusingly similar names or trademarks.
- Sell or transfer Academy branding to another party.
- Use the brand for unauthorized activities.
- Publish misleading claims about the Academy.
- Represent themselves as the owner of the Academy.
7. Franchise Operations
The franchisee is responsible for maintaining professional and compliant day-to-day operations of the franchise centre.
The franchisee is expected to:
- Maintain appropriate infrastructure.
- Maintain student and operational records.
- Follow Academy procedures and guidelines.
- Provide accurate information to students.
- Maintain professional staff and support.
- Protect student information and documents.
- Follow applicable educational and business laws.
The Academy may issue reasonable operational guidelines from time to time for maintaining quality and consistency across franchise locations.
8. Student Admission & Fee Collection
Franchisees may facilitate student admissions and related services only for courses and programs approved by GCC Education Academy.
The franchisee must provide students with accurate information concerning course details, fees, examination requirements, documents and certificates.
Student records
Student information must be entered and maintained accurately in the applicable system. Duplicate, fraudulent or misleading student registrations are prohibited.
Unauthorized promises
A franchisee must not guarantee employment, government recognition, examination results, certificate approval or any other outcome unless expressly authorized in official written communication.
9. Examination & Certificate
Certificates, marksheets, examination records and other academic documents shall be issued only through the applicable official process of GCC Education Academy.
A franchisee must not create, print, modify, duplicate, forge or issue unauthorized certificates or academic documents.
Any attempt to create or use fake, altered or unauthorized academic documents may result in immediate suspension or termination of the franchise relationship and may also lead to appropriate legal action.
10. Marketing & Advertising
Franchisees may promote approved GCC Education Academy services using authorized branding and marketing materials.
Marketing must not contain:
- False or misleading claims.
- Fake accreditation claims.
- Guaranteed employment promises.
- Guaranteed government job claims.
- False salary or placement guarantees.
- Unauthorized discounts or offers.
- Misleading certificate recognition claims.
Any promotional material must accurately represent the services actually available through the Academy.
11. Confidentiality & Data Protection
The franchisee may receive confidential information relating to students, business operations, systems, pricing, training materials, procedures or other internal matters.
Such information must be protected from unauthorized access, disclosure, copying or misuse.
- Do not share student information without authorization.
- Do not share login credentials.
- Do not sell or misuse Academy data.
- Maintain reasonable security for records.
- Report suspected unauthorized access promptly.
12. Legal & Regulatory Compliance
The franchisee is responsible for complying with all laws, rules, regulations, licences, registrations, local requirements and tax obligations applicable to its own operations.
The franchisee must not use the GCC Education Academy brand for any illegal, fraudulent or unauthorized activity.
13. Transfer or Assignment
A franchisee must not sell, transfer, assign, lease or otherwise hand over the franchise rights to another person or entity without prior written approval from GCC Education Academy.
Any unauthorized transfer may be treated as a material breach of the franchise terms.
14. Renewal
Franchise validity and renewal shall be governed by the applicable franchise period and renewal terms communicated by GCC Education Academy.
Renewal may be subject to payment of the applicable renewal fee, satisfactory compliance, updated documentation and approval by the Academy.
Renewal is not automatic unless expressly confirmed by GCC Education Academy in writing.
15. Suspension of Franchise
GCC Education Academy may suspend franchise access, systems, services, branding permissions or other franchise facilities where there is a reasonable concern regarding non-compliance, misuse or breach.
Possible reasons include:
- Non-payment of applicable dues.
- Fraudulent activity.
- Misuse of Academy branding.
- Fake or unauthorized certificates.
- Student complaints involving serious misconduct.
- False advertising.
- Unauthorized transfer of franchise.
- Violation of applicable policies.
16. Termination
The franchise relationship may be terminated in accordance with the applicable franchise agreement, written terms or where permitted by law.
Termination may occur due to:
- Material breach of franchise terms.
- Fraud or dishonest conduct.
- Unauthorized use of the brand.
- Issuance or creation of fake documents.
- Serious or repeated student complaints.
- Unauthorized financial activity.
- Illegal use of Academy services.
- Failure to comply with important operational requirements.
Upon termination, the franchisee must stop representing itself as an authorized GCC Education Academy franchise and discontinue unauthorized use of Academy branding, systems and materials.
17. No Refund Policy for Franchise Payments
Franchise registration fees, franchise fees, renewal fees, training fees, service fees and other applicable payments are non-refundable, subject to applicable law.
No refund shall ordinarily be provided merely because the franchisee:
- Changes their mind.
- Does not start operations.
- Stops operating the centre.
- Does not achieve expected business results.
- Does not generate expected student admissions.
- Decides to discontinue the franchise.
- Fails to use available services.
- Does not renew the franchise.
This provision does not attempt to exclude any refund, remedy or consumer right that is mandatory under applicable law.
18. Business Responsibility & Liability
A franchise is an independent business arrangement and business results may vary depending on location, marketing, student demand, management, competition, operational quality and other factors.
GCC Education Academy does not guarantee any specific level of income, profit, student admissions, business turnover or return on investment unless expressly stated in a written agreement.
The franchisee remains responsible for its own operational decisions, employees, premises, local expenses, taxes and statutory obligations.
19. Indemnification
To the extent permitted by applicable law, the franchisee may be responsible for losses, claims, penalties, damages or expenses arising from the franchisee's unauthorized acts, misconduct, breach of these terms or violation of applicable law.
20. Changes to Franchise Terms
GCC Education Academy may update operational policies, procedures, service requirements and these terms from time to time.
Updated terms may be published on the official website or communicated through appropriate official channels.
Continued use of the franchise services after an applicable update may constitute acceptance of the updated terms, subject to applicable law.
21. Force Majeure
Neither party shall be considered responsible for delay or inability to perform obligations to the extent caused by circumstances beyond reasonable control, including natural disasters, governmental restrictions, internet or infrastructure failures, major technical disruptions, war, civil disturbance or other extraordinary events.
22. Governing Law & Jurisdiction
These Franchise Terms & Conditions shall be interpreted in accordance with the applicable laws of India.
Any dispute shall be handled through the appropriate legal forum having jurisdiction, subject to any separate written agreement between the parties and applicable law.
23. Severability
If any provision of these terms is determined to be invalid, unlawful or unenforceable, the remaining provisions shall continue to the extent permitted by applicable law.
24. Entire Understanding
These terms, together with any applicable written franchise agreement, application, approval documents, policies and official instructions, form the framework governing the franchise relationship.
In case of a conflict between documents, the specific written franchise agreement may prevail to the extent expressly provided in that agreement and permitted by applicable law.
