GCC Education Lifetime Franchise Agreement / लाइफटाइम फ्रेंचाइज़ एग्रीमेंट

1. Franchise Application & Eligibility / फ्रेंचाइज़ आवेदन एवं पात्रता

The applicant must provide complete, correct and truthful information and documents. GCC Education may verify the information before approval and may refuse an application where the information, documents, location or proposed operation does not satisfy GCC Education requirements. आवेदक को पूर्ण, सही एवं सत्य जानकारी तथा आवश्यक दस्तावेज उपलब्ध कराने होंगे। GCC Education स्वीकृति से पहले दी गई जानकारी का सत्यापन कर सकता है तथा यदि जानकारी, दस्तावेज, स्थान या प्रस्तावित संचालन GCC Education की आवश्यकताओं के अनुरूप नहीं है तो आवेदन अस्वीकार कर सकता है।

2. Document Verification / दस्तावेज सत्यापन

All documents and information submitted by the applicant may be verified by GCC Education. Incorrect, incomplete, misleading, forged or false information may result in rejection, suspension or cancellation of the franchise authorization and may also lead to legal action where applicable. आवेदक द्वारा जमा किए गए सभी दस्तावेज एवं जानकारी का GCC Education द्वारा सत्यापन किया जा सकता है। गलत, अधूरी, भ्रामक, जाली या झूठी जानकारी के कारण फ्रेंचाइज़ आवेदन अस्वीकार, निलंबित या रद्द किया जा सकता है तथा लागू कानून के अनुसार कानूनी कार्रवाई भी हो सकती है।

3. Center Space & Infrastructure / सेंटर स्थान एवं बुनियादी सुविधाएँ

• The center should have suitable and reasonably accessible space for students.सेंटर में विद्यार्थियों के लिए उपयुक्त एवं आसानी से पहुंच योग्य स्थान होना चाहिए।
• The center should maintain basic seating, electricity, lighting, ventilation and other necessary facilities.सेंटर में बैठने की व्यवस्था, बिजली, प्रकाश, वेंटिलेशन तथा अन्य आवश्यक सुविधाएँ होनी चाहिए।
• Computer/laptop and internet facilities should be available where required.जहाँ आवश्यक हो वहाँ कंप्यूटर/लैपटॉप एवं इंटरनेट की सुविधा उपलब्ध होनी चाहिए।
• GCC Education may verify the center and may require reasonable improvements before or after approval.GCC Education सेंटर का सत्यापन कर सकता है तथा स्वीकृति से पहले या बाद में आवश्यक सुधार करने के लिए कह सकता है।

4. Franchise Approval / फ्रेंचाइज़ स्वीकृति

Submission of an application or payment of the registration fee does not by itself constitute final approval. The franchise becomes officially active only after GCC Education completes its applicable verification and approval process and provides authorization. केवल आवेदन जमा करने या रजिस्ट्रेशन शुल्क का भुगतान करने से अंतिम स्वीकृति नहीं मानी जाएगी। फ्रेंचाइज़ GCC Education द्वारा आवश्यक सत्यापन एवं स्वीकृति प्रक्रिया पूरी करने तथा अधिकृत अनुमति देने के बाद ही आधिकारिक रूप से सक्रिय होगी।

5. Lifetime Franchise Validity / लाइफटाइम फ्रेंचाइज़ वैधता

The franchise is intended to remain valid for the lifetime of the franchise relationship, provided the franchisee remains compliant, active and authorized. Lifetime validity does not prevent GCC Education from suspending or terminating the franchise for material breach, fraud, inactivity, brand misuse, unauthorized activity or other grounds stated in this Agreement.फ्रेंचाइज़ संबंध की अवधि तक फ्रेंचाइज़ लाइफटाइम वैध रहने के लिए है, बशर्ते फ्रेंचाइज़ी नियमों का पालन करता रहे, सक्रिय रहे और अधिकृत रहे। लाइफटाइम वैधता GCC Education को गंभीर उल्लंघन, धोखाधड़ी, निष्क्रियता, ब्रांड के दुरुपयोग, अनधिकृत गतिविधि या इस एग्रीमेंट में बताए गए अन्य कारणों से फ्रेंचाइज़ निलंबित या समाप्त करने से नहीं रोकती।

6. One-Time Franchise Registration Fee / एकमुश्त फ्रेंचाइज़ रजिस्ट्रेशन शुल्क

The ₹5,000/- registration fee is payable once for franchise registration. The fee is non-refundable and payment does not remove the requirement to complete verification, approval and compliance. The franchisee should retain the payment receipt or transaction record.₹5,000/- रजिस्ट्रेशन शुल्क फ्रेंचाइज़ पंजीकरण के लिए केवल एक बार देय है। यह शुल्क गैर-वापसी योग्य है और भुगतान करने से सत्यापन, स्वीकृति एवं नियमों के पालन की आवश्यकता समाप्त नहीं होती। फ्रेंचाइज़ी को भुगतान की रसीद या ट्रांजैक्शन रिकॉर्ड सुरक्षित रखना चाहिए।

7. Franchise Area Protection / फ्रेंचाइज़ क्षेत्र सुरक्षा

After an approved franchise center is officially opened and remains active and compliant, GCC Education will ordinarily not approve another GCC Education franchise within a 2 kilometre radius of the approved center, subject to the applicable franchise policy and the officially recorded center location. किसी स्वीकृत फ्रेंचाइज़ सेंटर के आधिकारिक रूप से खुलने और सक्रिय एवं नियमों के अनुरूप बने रहने के बाद, लागू फ्रेंचाइज़ नीति तथा GCC Education में दर्ज आधिकारिक सेंटर स्थान के अधीन, सामान्यतः स्वीकृत सेंटर के 2 किलोमीटर के दायरे में दूसरा GCC Education फ्रेंचाइज़ सेंटर स्वीकृत नहीं किया जाएगा।

8. Center Location & Area Protection / सेंटर स्थान एवं क्षेत्र सुरक्षा

The franchisee must not shift the approved center to another location without prior information and approval from GCC Education. A change of location may change, reduce or end the applicable 2 kilometre area protection. The final protected location will be the location officially approved and recorded by GCC Education. फ्रेंचाइज़ी GCC Education की पूर्व सूचना एवं स्वीकृति के बिना स्वीकृत सेंटर को किसी अन्य स्थान पर स्थानांतरित नहीं कर सकता। स्थान बदलने से 2 किलोमीटर की क्षेत्र सुरक्षा बदल, कम या समाप्त हो सकती है। अंतिम सुरक्षित स्थान वही होगा जिसे GCC Education द्वारा आधिकारिक रूप से स्वीकृत एवं रिकॉर्ड किया गया है।

9. Minimum Monthly Business Requirement / न्यूनतम मासिक व्यवसाय आवश्यकता

Every active franchise center is required to generate a minimum qualifying business of ₹1,500/- per month for GCC Education. For the purpose of this minimum requirement, the qualifying target is generally treated as being achieved through either 5 valid admissions in eligible 1–6 month courses or 3 valid admissions in eligible 1-year courses, subject to GCC Education verification and applicable fee rules.प्रत्येक सक्रिय फ्रेंचाइज़ सेंटर को GCC Education के लिए प्रति माह न्यूनतम ₹1,500/- का योग्य व्यवसाय करना आवश्यक है। इस न्यूनतम आवश्यकता के लिए सामान्यतः लक्ष्य या तो 1–6 महीने के पात्र कोर्स में 5 वैध एडमिशन या 1 वर्ष के पात्र कोर्स में 3 वैध एडमिशन के माध्यम से पूरा माना जाएगा, जो GCC Education के सत्यापन एवं लागू शुल्क नियमों के अधीन होगा।

10. Meaning of Valid Business / Admission / वैध व्यवसाय / एडमिशन का अर्थ

• An admission must be genuine, paid/recorded through the approved process and supported by required student information.एडमिशन वास्तविक होना चाहिए, स्वीकृत प्रक्रिया के माध्यम से भुगतान/रिकॉर्ड किया गया होना चाहिए और आवश्यक विद्यार्थी जानकारी से समर्थित होना चाहिए।
• Cancelled, duplicate, fake, reversed, fraudulent or otherwise invalid admissions will not count.रद्द, डुप्लीकेट, नकली, रिवर्स, धोखाधड़ी वाले या अन्यथा अमान्य एडमिशन की गणना नहीं की जाएगी।
• GCC Education may verify admission records before counting them toward a business target or incentive.GCC Education व्यवसाय लक्ष्य या इंसेंटिव में शामिल करने से पहले एडमिशन रिकॉर्ड का सत्यापन कर सकता है।
• GCC Education may publish or update operational definitions and eligible course categories through official communication.GCC Education आधिकारिक संचार के माध्यम से संचालन संबंधी परिभाषाएँ और पात्र कोर्स श्रेणियाँ जारी या अपडेट कर सकता है।

11. Six-Month Inactivity Rule / छह माह निष्क्रियता नियम

Reactivation, if permitted, will be at GCC Education's discretion and may require verification, updated documents or compliance with the then-current franchise policy.यदि पुनः सक्रिय करने की अनुमति दी जाती है, तो यह GCC Education के विवेक पर होगी और इसके लिए सत्यापन, अपडेटेड दस्तावेज या उस समय लागू फ्रेंचाइज़ नीति का पालन आवश्यक हो सकता है।

12. Monthly Incentive / Gift / मासिक इंसेंटिव / गिफ्ट

• A franchise center achieving ₹3,000/- or more qualifying business in a month may become eligible for a special gift or incentive.एक माह में ₹3,000/- या अधिक योग्य व्यवसाय करने वाला फ्रेंचाइज़ सेंटर विशेष गिफ्ट या इंसेंटिव के लिए पात्र हो सकता है।
• Only genuine, valid and verified business will be counted.केवल वास्तविक, वैध एवं सत्यापित व्यवसाय की गणना की जाएगी।
• The gift/incentive is subject to verification and the applicable GCC Education incentive policy.गिफ्ट/इंसेंटिव सत्यापन एवं लागू GCC Education इंसेंटिव नीति के अधीन होगा।
• The type, value, delivery method and timing of the gift/incentive will be determined by GCC Education.गिफ्ट/इंसेंटिव का प्रकार, मूल्य, वितरण तरीका एवं समय GCC Education निर्धारित करेगा।
• GCC Education may modify, suspend or discontinue the incentive scheme by official policy.GCC Education आधिकारिक नीति द्वारा इंसेंटिव योजना में बदलाव, निलंबन या समाप्ति कर सकता है।

13. Student Fee Entitlement of Franchisee / फ्रेंचाइज़ी का विद्यार्थी शुल्क अधिकार

The franchisee may retain the balance after paying the applicable GCC Education amount for each eligible student and after complying with the approved payment/reporting process. No unauthorized amount may be represented as an official GCC Education charge.फ्रेंचाइज़ी प्रत्येक पात्र विद्यार्थी के लिए लागू GCC Education राशि का भुगतान करने और स्वीकृत भुगतान/रिपोर्टिंग प्रक्रिया का पालन करने के बाद शेष राशि अपने पास रख सकता है। किसी अनधिकृत राशि को आधिकारिक GCC Education शुल्क के रूप में प्रस्तुत नहीं किया जा सकता।

14. GCC Education Per-Student Fee / प्रति विद्यार्थी GCC Education शुल्क

• 1–6 Month Course: ₹300/- per student payable to GCC Education. / 1–6 महीने का कोर्स: प्रति विद्यार्थी ₹300/- GCC Education को देय।
• 1-Year Course: ₹500/- per student payable to GCC Education. / 1 वर्ष का कोर्स: प्रति विद्यार्थी ₹500/- GCC Education को देय।
• The applicable amount is linked to the student's approved course category and valid admission.लागू राशि विद्यार्थी की स्वीकृत कोर्स श्रेणी और वैध एडमिशन पर आधारित होगी।
• Payment and reporting must follow the process communicated by GCC Education.भुगतान एवं रिपोर्टिंग GCC Education द्वारा बताई गई प्रक्रिया के अनुसार करनी होगी।
• GCC Education may issue revised fee schedules for future admissions through official communication/policy.भविष्य के एडमिशन के लिए GCC Education आधिकारिक संचार/नीति के माध्यम से संशोधित शुल्क सूची जारी कर सकता है।

15. No Separate Franchise Center Fee Schedule / अलग फ्रेंचाइज़ सेंटर शुल्क सूची नहीं

This Agreement governs the franchise center relationship. Detailed student course fees are not fixed in this document. The franchisee must follow the course-wise fees, payment process and approved commercial instructions communicated by GCC Education from time to time. यह एग्रीमेंट फ्रेंचाइज़ सेंटर के संबंध को नियंत्रित करता है। विद्यार्थी कोर्स की विस्तृत फीस इस दस्तावेज में निश्चित नहीं की गई है। फ्रेंचाइज़ी को समय-समय पर GCC Education द्वारा बताई गई कोर्स-वार फीस, भुगतान प्रक्रिया एवं स्वीकृत व्यावसायिक निर्देशों का पालन करना होगा।

16. Student Admission & Records / विद्यार्थी एडमिशन एवं रिकॉर्ड

The franchisee must maintain accurate admission, student, fee, examination and related records. Records must be available for verification when reasonably required by GCC Education. The franchisee must not create duplicate or fictitious admissions for targets, incentives or reporting. फ्रेंचाइज़ी को एडमिशन, विद्यार्थी, फीस, परीक्षा एवं संबंधित रिकॉर्ड सही तरीके से रखना होगा। आवश्यकता होने पर GCC Education के सत्यापन के लिए रिकॉर्ड उपलब्ध कराने होंगे। लक्ष्य, इंसेंटिव या रिपोर्टिंग के लिए डुप्लीकेट या काल्पनिक एडमिशन नहीं बनाए जा सकते।

17. Marksheet & Certificate Issuance / मार्कशीट एवं प्रमाणपत्र जारी करना

• Official marksheets and certificates will be issued by the GCC Education Head Office or through an officially authorized GCC Education system.आधिकारिक मार्कशीट एवं प्रमाणपत्र GCC Education Head Office या आधिकारिक रूप से अधिकृत GCC Education सिस्टम द्वारा जारी किए जाएंगे।
• The franchisee must not independently create, print, sign, alter or authorize official GCC Education marksheets or certificates unless expressly authorized in writing.फ्रेंचाइज़ी लिखित अनुमति के बिना स्वयं आधिकारिक GCC Education मार्कशीट या प्रमाणपत्र बना, प्रिंट, हस्ताक्षर, संशोधित या अधिकृत नहीं कर सकता।
• Eligible official certificates/marksheets will carry a unique serial number or verification identifier as applicable.पात्र आधिकारिक प्रमाणपत्र/मार्कशीट पर लागू होने के अनुसार यूनिक सीरियल नंबर या सत्यापन पहचान होगी।
• Certificates/marksheets may be verified through the official online verification system where such system is provided.जहाँ आधिकारिक ऑनलाइन सत्यापन प्रणाली उपलब्ध होगी, वहाँ प्रमाणपत्र/मार्कशीट का ऑनलाइन सत्यापन किया जा सकता है।

18. Students Already Admitted Before Franchise Cancellation / फ्रेंचाइज़ रद्द होने से पहले एडमिट विद्यार्थी

Subject to valid records, applicable course requirements and verification, GCC Education will process eligible marksheets/certificates for students who were already validly admitted before the franchise cancellation. The franchisee must cooperate in providing complete records required for such processing.वैध रिकॉर्ड, लागू कोर्स आवश्यकताओं एवं सत्यापन के अधीन, फ्रेंचाइज़ रद्द होने से पहले वैध रूप से एडमिट विद्यार्थियों की पात्र मार्कशीट/प्रमाणपत्र प्रक्रिया GCC Education द्वारा की जाएगी। फ्रेंचाइज़ी को आवश्यक पूर्ण रिकॉर्ड उपलब्ध कराने में सहयोग करना होगा।

19. Duplicate Marksheet / Certificate / डुप्लीकेट मार्कशीट / प्रमाणपत्र

A duplicate official marksheet or certificate may be issued only after verification by GCC Education. The student/requestor may be required to provide identification, admission details, previous serial number or other supporting documents. Duplicate documents will be issued only through GCC Education Head Office or an officially authorized process. A franchisee is not permitted to independently generate a duplicate official document. डुप्लीकेट आधिकारिक मार्कशीट या प्रमाणपत्र GCC Education के सत्यापन के बाद ही जारी किया जा सकता है। विद्यार्थी/आवेदक से पहचान, एडमिशन विवरण, पूर्व सीरियल नंबर या अन्य सहायक दस्तावेज मांगे जा सकते हैं। डुप्लीकेट दस्तावेज केवल GCC Education Head Office या अधिकृत प्रक्रिया के माध्यम से जारी होंगे। फ्रेंचाइज़ी स्वयं डुप्लीकेट आधिकारिक दस्तावेज नहीं बना सकता।

20. Fake / Forged / Unauthorized Certificate / नकली / जाली / अनधिकृत प्रमाणपत्र

Any suspected fake certificate may be investigated and preserved as evidence. The franchisee will be responsible for consequences arising from unauthorized documents issued through its center, subject to applicable law.किसी संदिग्ध नकली प्रमाणपत्र की जांच की जा सकती है और उसे साक्ष्य के रूप में सुरक्षित रखा जा सकता है। उसके सेंटर के माध्यम से जारी अनधिकृत दस्तावेजों से उत्पन्न परिणामों के लिए, लागू कानून के अधीन, फ्रेंचाइज़ी जिम्मेदार होगा।

21. GCC Education Name, Logo, Trademark & Brand / नाम, लोगो, ट्रेडमार्क एवं ब्रांड

• GCC Education name, logo, trademark, certificate design, letterhead, seal, website content, software, dashboard, QR/verification system, course material, study material, photographs, videos, designs and other brand assets remain under the ownership/control of GCC Education or the relevant rights holder.GCC Education का नाम, लोगो, ट्रेडमार्क, प्रमाणपत्र डिजाइन, लेटरहेड, सील, वेबसाइट सामग्री, सॉफ्टवेयर, डैशबोर्ड, QR/सत्यापन प्रणाली, कोर्स सामग्री, अध्ययन सामग्री, फोटो, वीडियो, डिजाइन और अन्य ब्रांड संपत्तियाँ GCC Education या संबंधित अधिकार धारक के स्वामित्व/नियंत्रण में रहेंगी।
• The franchisee receives only a limited, non-transferable permission to use approved brand assets for authorized franchise activities during the active franchise relationship.फ्रेंचाइज़ी को सक्रिय फ्रेंचाइज़ संबंध के दौरान अधिकृत गतिविधियों के लिए स्वीकृत ब्रांड संपत्तियों के उपयोग की सीमित एवं गैर-हस्तांतरणीय अनुमति मिलती है।
• The franchisee shall not register or attempt to register GCC Education marks, confusingly similar marks, domains, social media handles or other identifiers in its own name without written authorization.लिखित अनुमति के बिना फ्रेंचाइज़ी GCC Education के ट्रेडमार्क, समान दिखने वाले मार्क, डोमेन, सोशल मीडिया हैंडल या अन्य पहचान अपने नाम से रजिस्टर या रजिस्टर कराने का प्रयास नहीं करेगा।
• The franchisee shall not modify, copy, sell, license, sublicense or commercially exploit GCC Education intellectual property outside approved activities.फ्रेंचाइज़ी स्वीकृत गतिविधियों के बाहर GCC Education की बौद्धिक संपदा को बदल, कॉपी, बेच, लाइसेंस, सब-लाइसेंस या व्यावसायिक रूप से उपयोग नहीं करेगा।
• On suspension or termination, the franchisee must stop representing itself as an authorized GCC Education franchise and remove unauthorized GCC branding as instructed.निलंबन या समाप्ति पर फ्रेंचाइज़ी को स्वयं को अधिकृत GCC Education फ्रेंचाइज़ बताना बंद करना होगा और निर्देशानुसार अनधिकृत GCC ब्रांडिंग हटानी होगी।

22. Course Material, Software & Digital Systems / कोर्स सामग्री, सॉफ्टवेयर एवं डिजिटल सिस्टम

Course content, study material, examination systems, software, dashboard access, databases, templates, certificate formats, QR verification systems and other digital or educational resources supplied by GCC Education are for authorized use only. The franchisee shall not copy, resell, reverse engineer, redistribute or provide unauthorized access to such resources. GCC Education द्वारा दी गई कोर्स सामग्री, अध्ययन सामग्री, परीक्षा प्रणाली, सॉफ्टवेयर, डैशबोर्ड एक्सेस, डेटाबेस, टेम्पलेट, प्रमाणपत्र प्रारूप, QR सत्यापन प्रणाली तथा अन्य डिजिटल/शैक्षणिक संसाधन केवल अधिकृत उपयोग के लिए हैं। फ्रेंचाइज़ी इन संसाधनों को कॉपी, पुनर्विक्रय, रिवर्स इंजीनियर, पुनर्वितरित या अनधिकृत एक्सेस प्रदान नहीं करेगा।

23. Marketing & Advertisement / मार्केटिंग एवं विज्ञापन

All advertising must be truthful and consistent with approved GCC Education information. The franchisee must not claim guaranteed employment, guaranteed government approval, guaranteed results, guaranteed income or any other misleading benefit unless specifically authorized and factually applicable. सभी विज्ञापन सत्य एवं स्वीकृत GCC Education जानकारी के अनुरूप होने चाहिए। फ्रेंचाइज़ी बिना विशेष अनुमति और तथ्यात्मक आधार के गारंटीड रोजगार, गारंटीड सरकारी स्वीकृति, गारंटीड परिणाम, गारंटीड आय या कोई अन्य भ्रामक लाभ का दावा नहीं करेगा।

24. Student Protection & Data Confidentiality / विद्यार्थी सुरक्षा एवं डेटा गोपनीयता

The franchisee must protect student/customer information and use it only for legitimate franchise, academic, examination, support, communication and compliance purposes. Login credentials, internal documents, business information and non-public GCC Education information must not be disclosed or misused. फ्रेंचाइज़ी को विद्यार्थी/ग्राहक जानकारी की सुरक्षा करनी होगी और उसका उपयोग केवल वैध फ्रेंचाइज़, शैक्षणिक, परीक्षा, सहायता, संचार एवं अनुपालन उद्देश्यों के लिए करना होगा। लॉगिन क्रेडेंशियल, आंतरिक दस्तावेज, व्यावसायिक जानकारी एवं गैर-सार्वजनिक GCC Education जानकारी का खुलासा या दुरुपयोग नहीं किया जाएगा।

25. Account & Login Security / अकाउंट एवं लॉगिन सुरक्षा

Center ID, username, password, dashboard access, QR/certificate access and other credentials must be kept confidential. Sharing credentials with unauthorized persons is prohibited. Suspected unauthorized access must be reported to GCC Education promptly. सेंटर ID, यूजरनेम, पासवर्ड, डैशबोर्ड एक्सेस, QR/प्रमाणपत्र एक्सेस एवं अन्य क्रेडेंशियल गोपनीय रखे जाएंगे। अनधिकृत व्यक्तियों के साथ क्रेडेंशियल साझा करना प्रतिबंधित है। अनधिकृत एक्सेस की आशंका होने पर GCC Education को तुरंत सूचित करना होगा।

26. Payment & Financial Records / भुगतान एवं वित्तीय रिकॉर्ड

Payments payable to GCC Education must be made through the approved process. The franchisee must maintain proper student fee and payment records and must not collect or represent any unauthorized charge as an official GCC Education fee. GCC Education may require reasonable payment reconciliation. GCC Education को देय भुगतान स्वीकृत प्रक्रिया के माध्यम से किया जाना चाहिए। फ्रेंचाइज़ी को विद्यार्थी फीस एवं भुगतान के उचित रिकॉर्ड रखने होंगे और किसी अनधिकृत शुल्क को आधिकारिक GCC Education फीस के रूप में नहीं दिखाना होगा। GCC Education उचित भुगतान मिलान/सत्यापन की मांग कर सकता है।

27. Inspection, Verification & Audit / निरीक्षण, सत्यापन एवं ऑडिट

GCC Education may reasonably review or verify center operations, student records, admission data, payment records, branding, certificates, login activity and compliance. The franchisee shall cooperate with such verification and provide requested records within a reasonable period. GCC Education सेंटर संचालन, विद्यार्थी रिकॉर्ड, एडमिशन डेटा, भुगतान रिकॉर्ड, ब्रांडिंग, प्रमाणपत्र, लॉगिन गतिविधि एवं नियमों के अनुपालन की उचित समीक्षा या सत्यापन कर सकता है। फ्रेंचाइज़ी को ऐसे सत्यापन में सहयोग करना होगा और मांगे गए रिकॉर्ड उचित समय में उपलब्ध कराने होंगे।

28. Franchise Transfer / Sale / फ्रेंचाइज़ ट्रांसफर / बिक्री

The franchise authorization is personal to the approved franchisee and may not be sold, transferred, assigned, rented, sub-franchised or handed over to another person without prior written approval from GCC Education. Any unauthorized transfer may result in immediate suspension or cancellation. फ्रेंचाइज़ अनुमति स्वीकृत फ्रेंचाइज़ी के लिए व्यक्तिगत है और GCC Education की पूर्व लिखित अनुमति के बिना इसे बेचा, ट्रांसफर, असाइन, किराए पर, सब-फ्रेंचाइज़ या किसी अन्य व्यक्ति को सौंपा नहीं जा सकता। अनधिकृत ट्रांसफर से तत्काल निलंबन या रद्दीकरण हो सकता है।

29. Suspension / निलंबन

GCC Education may suspend the franchise, temporarily restrict access or withhold franchise benefits where there is serious or repeated non-compliance, false information, payment default, inactivity, unauthorized activity, brand misuse, fake documents, serious complaints, data misuse or other material breach. Where appropriate, GCC Education may provide notice and an opportunity to rectify the issue. गंभीर या बार-बार नियमों का उल्लंघन, गलत जानकारी, भुगतान में चूक, निष्क्रियता, अनधिकृत गतिविधि, ब्रांड दुरुपयोग, नकली दस्तावेज, गंभीर शिकायत, डेटा दुरुपयोग या अन्य महत्वपूर्ण उल्लंघन की स्थिति में GCC Education फ्रेंचाइज़ निलंबित, अस्थायी रूप से एक्सेस सीमित या फ्रेंचाइज़ लाभ रोक सकता है। जहाँ उचित होगा, GCC Education सूचना देकर समस्या सुधारने का अवसर दे सकता है।

30. Termination / Cancellation / समाप्ति / रद्दीकरण

GCC Education may terminate or cancel the franchise for persistent non-compliance, six-month qualifying-business inactivity, fraud, fake/forged certificates, serious misconduct, unauthorized transfer, brand/IP misuse, unauthorized representation, repeated payment/business violations or other material breach of this Agreement. Immediate action may be taken for serious fraud, fake certificates or conduct that may cause significant harm to GCC Education or students. लगातार नियमों का पालन न करने, छह माह योग्य व्यवसाय निष्क्रियता, धोखाधड़ी, नकली/जाली प्रमाणपत्र, गंभीर दुराचार, अनधिकृत ट्रांसफर, ब्रांड/IP दुरुपयोग, अनधिकृत प्रतिनिधित्व, बार-बार भुगतान/व्यवसाय उल्लंघन या इस एग्रीमेंट के अन्य महत्वपूर्ण उल्लंघन पर GCC Education फ्रेंचाइज़ समाप्त या रद्द कर सकता है। गंभीर धोखाधड़ी, नकली प्रमाणपत्र या GCC Education/विद्यार्थियों को महत्वपूर्ण नुकसान पहुंचाने वाले आचरण में तत्काल कार्रवाई की जा सकती है।

31. Effect of Termination / समाप्ति का प्रभाव

• Franchise login/access and authorization may be disabled.फ्रेंचाइज़ लॉगिन/एक्सेस एवं अनुमति बंद की जा सकती है।
• The franchisee must stop using GCC Education name, logo, certificates, letterhead, marketing material and other protected assets as instructed.फ्रेंचाइज़ी को निर्देशानुसार GCC Education नाम, लोगो, प्रमाणपत्र, लेटरहेड, मार्केटिंग सामग्री एवं अन्य संरक्षित संपत्तियों का उपयोग बंद करना होगा।
• The franchisee must not represent itself as an active/authorized GCC Education franchise.फ्रेंचाइज़ी स्वयं को सक्रिय/अधिकृत GCC Education फ्रेंचाइज़ के रूप में प्रस्तुत नहीं करेगा।
• Valid student records already created before termination may continue to be processed according to GCC Education verification and policy.समाप्ति से पहले बनाए गए वैध विद्यार्थी रिकॉर्ड GCC Education के सत्यापन एवं नीति के अनुसार आगे प्रक्रिया में लिए जा सकते हैं।
• Termination does not create any right to refund of the ₹5,000/- non-refundable registration fee.समाप्ति से ₹5,000/- गैर-वापसी योग्य रजिस्ट्रेशन शुल्क की वापसी का कोई अधिकार उत्पन्न नहीं होगा।

32. Refund Policy / रिफंड नीति

The ₹5,000/- one-time franchise registration fee is non-refundable. Any refund relating to a separate student service or payment, if applicable, will be governed by the specific policy applicable to that service/payment. Nothing in this clause prevents GCC Education from complying with any mandatory legal requirement. ₹5,000/- एकमुश्त फ्रेंचाइज़ रजिस्ट्रेशन शुल्क गैर-वापसी योग्य है। किसी अलग विद्यार्थी सेवा या भुगतान से संबंधित रिफंड, यदि लागू हो, तो उस सेवा/भुगतान की विशेष नीति के अनुसार होगा। इस प्रावधान में कोई बात GCC Education को किसी अनिवार्य कानूनी आवश्यकता का पालन करने से नहीं रोकेगी।

33. Notice & Official Communication / सूचना एवं आधिकारिक संचार

The franchisee is responsible for keeping its registered mobile number and email address current. Notices, policy updates, compliance instructions, payment instructions and other official communications may be sent to the registered WhatsApp number and/or email address. The franchisee should regularly check both channels.फ्रेंचाइज़ी अपने पंजीकृत मोबाइल नंबर एवं ईमेल पते को अपडेट रखने के लिए जिम्मेदार है। नोटिस, नीति अपडेट, अनुपालन निर्देश, भुगतान निर्देश एवं अन्य आधिकारिक संचार पंजीकृत WhatsApp नंबर और/या ईमेल पर भेजे जा सकते हैं। फ्रेंचाइज़ी को दोनों माध्यम नियमित रूप से जांचने चाहिए।

34. Dispute, Administrator Decision & Jurisdiction / विवाद, प्रशासक का निर्णय एवं क्षेत्राधिकार

Any dispute or disagreement relating to the franchise relationship should first be placed before the authorized GCC Education Administrator for internal administrative review. The decision of the authorized GCC Education Administrator shall be final for GCC Education's internal administrative process, subject to applicable law. Subject to applicable law, courts of competent jurisdiction at Raipur, Chhattisgarh shall have jurisdiction over legal proceedings arising from or relating to this Agreement. फ्रेंचाइज़ संबंध से संबंधित किसी विवाद या असहमति को पहले आंतरिक प्रशासनिक समीक्षा के लिए अधिकृत GCC Education Administrator के समक्ष रखा जाना चाहिए। लागू कानून के अधीन, अधिकृत GCC Education Administrator का निर्णय GCC Education की आंतरिक प्रशासनिक प्रक्रिया के लिए अंतिम होगा। लागू कानून के अधीन, इस एग्रीमेंट से उत्पन्न या संबंधित कानूनी कार्यवाही के लिए रायपुर, छत्तीसगढ़ के सक्षम न्यायालयों का क्षेत्राधिकार होगा।
